3. Eligibility and Trade Accounts
3.1 You must be at least 18 years old and legally capable of entering into binding contracts to use this Website or place an Order.
3.2 The Website may offer both retail purchasing and trade account purchasing. Trade account applicants must complete a separate credit application, which is subject to our approval and separate Trade Account Terms.
3.3 You are responsible for ensuring that any information you provide (including business, billing, and delivery details) is accurate, current, and complete.
3.4 Where you hold a trade account, you are responsible for all activity conducted under that account, including orders placed by authorised employees or representatives.
4. Website Use
4.1 You agree to use the Website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the Website by any third party.
4.2 You must not:
- Attempt to gain unauthorised access to the Website, our systems, or any account not belonging to you
- Use the Website to transmit any virus, malware, or harmful code
- Use automated systems (bots, scrapers) to extract data from the Website without our prior written consent
- Engage in fraudulent conduct, including placing orders using false or misleading information
4.3 We reserve the right to suspend or terminate your access to the Website or any account at our discretion, including for breach of these Terms.
5. Product Information

5.2 Colours, finishes, and dimensions shown on the Website are indicative only and may vary slightly from the actual Goods due to photography, screen display, or manufacturing tolerances.
5.3 It is your responsibility to ensure that any Goods purchased are suitable for your intended purpose, comply with relevant Australian Standards, and are installed or used by appropriately licensed and qualified personnel where required by law (for example, licensed electricians for electrical installation work).
5.4 We reserve the right to correct any errors, inaccuracies, or omissions in product information, pricing, or availability at any time, including after an Order has been submitted, and to cancel any Order affected by such an error.
6. Pricing and GST
6.1 All prices displayed on the Website are in Australian Dollars (AUD) and, unless stated otherwise, are inclusive of Goods and Services Tax (GST) where applicable.
6.2 Prices are subject to change without notice. The price applicable to your Order is the price displayed at the time you submit your Order, unless a pricing error has occurred (see clause 5.4).
6.3 Trade or bulk pricing, where applicable, is only available to approved trade account holders and is subject to the terms of the relevant trade account agreement.
6.4 Delivery, freight, and any applicable surcharges (e.g. card payment surcharges) are additional to the displayed product price unless stated otherwise, and will be shown at checkout prior to payment.
7. Orders and Acceptance
7.1 Submitting an Order through the Website constitutes an offer by you to purchase the Goods. We reserve the right to accept or decline any Order at our discretion, including where:
- Goods are unavailable or out of stock
- We identify a pricing or product description error
- We suspect fraudulent activity
- Payment cannot be verified or processed
- Your trade account is not in good standing
7.2 A contract for the sale of Goods is only formed once we confirm acceptance of your Order (for example, by sending a confirmation email or dispatch notice). An automated order acknowledgement does not constitute acceptance.
7.3 We will notify you as soon as reasonably possible if we are unable to fulfil your Order, and any payment already made will be refunded.
8. Payment
8.1 Payment must be made in full at the time of ordering, unless you hold an approved trade account with agreed credit terms.
8.2 We accept payment via the methods displayed at checkout (for example, credit/debit card, direct deposit, or approved trade account terms).
8.3 For trade account holders, payment terms (e.g. 30 days from invoice) will be as agreed in your Trade Account/Credit Application Terms. Late payments may incur interest and/or suspension of your account, in accordance with those terms.
8.4 You warrant that any payment information provided is accurate and that you are authorised to use the nominated payment method.
9. Delivery
9.1 Delivery timeframes provided on the Website or at checkout are estimates only and are not guaranteed. We are not liable for delays caused by circumstances beyond our reasonable control, including carrier delays, stock shortages, or force majeure events (see clause 17).
9.2 Delivery costs will be calculated at checkout based on your delivery address, order size, and weight, unless otherwise agreed for trade accounts.
9.3 Risk in the Goods (including risk of loss or damage) passes to you upon delivery to the address specified in your Order, or upon collection if you have chosen to collect Goods from our Minto premises.
9.4 It is your responsibility to inspect Goods upon delivery and notify us of any damage, shortage, or discrepancy within [Insert number, e.g. 48 hours] of delivery.
9.5 If you are not available to receive delivery, additional delivery charges or restocking fees may apply for redelivery.
10. Retention of Title
10.1 Notwithstanding delivery and the passing of risk in the Goods, ownership and title in the Goods will not pass to you until we have received payment in full (in cleared funds) for those Goods and all other amounts owing to us.
10.2 Until title passes:
- You hold the Goods as our bailee and must store them separately and identifiable as our property
- You must not sell, dispose of, encumber, or use the Goods as security for any other obligation, except in the ordinary course of your business as a reseller (if applicable)
- We may, without notice, enter your premises to recover Goods for which payment has not been received in full
10.3 If you resell the Goods before title has passed to you, you do so as our agent, and the proceeds of sale are held on trust for us until we have received payment in full.
11. Returns, Refunds, and Australian Consumer Law
11.1 Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you under the Australian Consumer Law (ACL) or other applicable law that cannot lawfully be excluded. Where the ACL applies, our Goods come with guarantees that cannot be excluded, including that Goods will be of acceptable quality and fit for the purpose disclosed.
11.2 If Goods are faulty, not fit for purpose, or do not match their description, and you are a Consumer under the ACL, you may be entitled to a repair, replacement, or refund in accordance with the ACL. For major failures, you may choose a refund or replacement; for minor failures, we may choose to remedy the fault.
11.3 For change-of-mind returns (where the fault does not lie with us), we may, at our discretion, accept returns of unused Goods in original, resalable packaging within [Insert number, e.g. 30 days] of delivery, subject to:
- Proof of purchase
- A restocking fee (if applicable)
- The Goods being unused, undamaged, and in original packaging
- Certain products being excluded from change-of-mind returns (e.g. special orders, cut cable/wire, custom or clearance items)
11.4 To initiate a return or report a fault, please contact us using the details in clause 22 before sending any Goods back.
11.5 Trade account holders may be subject to additional or different returns arrangements as set out in their Trade Account Terms.
12. Warranties
12.1 Goods sold by us may be covered by manufacturer warranties. Details of any applicable manufacturer warranty will be provided with the Goods or made available on request.
12.2 To the extent permitted by law, any implied warranties (other than the non-excludable consumer guarantees under the ACL referred to in clause 11.1) are excluded.
12.3 We do not warrant that the Goods are suitable for any particular installation or application beyond their standard specifications; suitability assessment for a specific project is the responsibility of the purchaser and/or the licensed tradesperson undertaking the installation.
13. Limitation of Liability
13.1 To the maximum extent permitted by law, and subject to clause 11.1, our liability for any claim arising out of or in connection with these Terms or the supply of Goods (whether in contract, tort, negligence, or otherwise) is limited, at our option, to:
- The replacement or repair of the Goods; or
- The resupply of equivalent Goods; or
- The cost of replacing, repairing, or resupplying the Goods
13.2 To the maximum extent permitted by law, we exclude all liability for indirect, special, or consequential loss, including loss of profits, loss of business, or loss of data, arising from the use of the Website or the supply of Goods.
13.3 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
14. Intellectual Property
14.1 All content on the Website, including text, graphics, logos, product images, and software, is owned by or licensed to Voltage Investments and is protected by Australian and international intellectual property laws.
14.2 You may not reproduce, distribute, modify, or create derivative works from any content on the Website without our prior written consent, except as necessary for normal use of the Website for personal or business purchasing purposes.
15. Privacy
Our collection and handling of your personal information is governed by our Privacy Policy, which forms part of these Terms.
16. Indemnity
To the extent permitted by law, you agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, and expenses (including legal costs) arising from your breach of these Terms, misuse of the Website, or misuse of Goods purchased from us, including improper or non-compliant installation.
17. Force Majeure
We will not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including natural disasters, supply chain disruptions, industrial action, or government restrictions.
18. Termination and Suspension
We reserve the right to suspend or terminate your access to the Website, your account, or your trade account at any time, with or without notice, in the event of a breach of these Terms, suspected fraud, or non-payment.
19. Dispute Resolution
19.1 If a dispute arises in connection with these Terms, both parties agree to first attempt to resolve the dispute in good faith through direct negotiation.
19.2 If the dispute cannot be resolved within a reasonable time, either party may pursue other remedies available at law.
20. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
21. Changes to These Terms
We may update these Terms from time to time to reflect changes in our business practices or legal obligations. The updated Terms will be posted on the Website with a revised “last updated” date, and continued use of the Website or placement of an Order after changes take effect constitutes acceptance of the updated Terms.
